What are my rights as a counseling client?

Among other rights, as per Section 181.105 of the Texas Health and Safety Code:

· You have the right to request certain portions of your mental health records.

  • Your therapist has 15 days to comply with your request but, by law and for your protection, your therapist may deny access to certain part of your records under limited circumstances. 
  • You may request that we provide your health records to you in an electronic format.
  • You may request amendment of your health information if you feel the health information is incorrect or incomplete. Under certain circumstances your therapist may deny your request.
  • If you would like to request a copy of your records please use this link contact me via email at auro.valdes@gmail.com. Do not leave me any personal details about your treatment. Simply send me your name and telephone so I can send you the right confidential form to request records.


You have the right to contact the Texas State Board of Examiners of Marriage and Family Therapists (part of the Texas Behavioral Executive Council). Their website is:


  • On their website  https://bhec.texas.gov/contact-us/ you can find further information on how to verify a therapist’s license, read about the laws governing Family Therapy. obtain information about ethical guidelines for this profession, etc.


· You have the right to file a complaint about your therapist with the Texas Behavioral Executive Council. The complaint must be done in writing using the form and instructions found on the link below.

 The Texas Behavioral Health Executive Council (BHEC) investigates and prosecutes professional misconduct committed by marriage and family therapists, professional counselors, psychologists, psychological associates, social workers, and licensed specialists in school psychology.

Although not every complaint against or dispute with a licensee involves professional misconduct, the Executive Council will provide you with information about how to file a complaint.
